Here is an good example of a non-binding contract case. Ashley Dupre (remember Eliot Spitzer’s call girl?) has filed a lawsuit against Joe Francis of Girls Gone Wild for $10 million dollars. Francis allegedly took topless videos of Ashley after she signed a release form while she was drunk. Further she was only 17 years of age which means she cannot enter into legally binding contracts. The claim is that the defendant profited from those videos and the plaintiff is seeking compensation.
If your business depends on signing release contracts with drunk girls who are possibly minors and then profiting from that pornographic content, you might as well wear a bulls eye.
